Hazardous Substance Consent has been clarified in Scotland

On the 01 December 2022 Note 5 of schedule 1 of The Town and Country Planning (Hazardous Substances) (Scotland) Regulations 2015 was amended to align with England. The amended regulations now require that even if quantities of one or more substances on site individually trigger the requirement for hazardous substances consent, the addition rule should still apply to other ‘below threshold substances’ in the same hazard group present on site.

There is a 12-month transition period for operators to ensure any necessary consents are in place. No enforcement action is to be taken within the 12-month transition period up to 30 November 2023.
