Hazardous Substance Consent has been clarified in Scotland
16th March 2023 - Written by David Gladman
On the 01 December 2022 Note 5 of schedule 1 of The Town and Country Planning (Hazardous Substances) (Scotland) Regulations 2015 was amended to align with England. The amended regulations now require that even if quantities of one or more substances on site individually trigger the requirement for hazardous substances consent, the addition rule should still apply to other ‘below threshold substances’ in the same hazard group present on site.
There is a 12-month transition period for operators to ensure any necessary consents are in place. No enforcement action is to be taken within the 12-month transition period up to 30 November 2023.
Does your site have a Hazardous Substance Consent?
If you have a hazardous substance consent, under the amendment in regulations you are required to review for other substances in the same hazard group to what is consented.
How Mabbett can Support.
Our integrated safety and planning team can undertake an initial review of site chemical inventory to understand if there are other substances to be included in your consent as well as help support a Hazardous Substances Consent application or variation.
